You agree that Luxury Hedge will not be liable in any way to you in the event of failure of or damage or destruction to your Computer systems, data or records or any part thereof, or for delays, losses, errors or omissions resulting from the failure or mismanagement of any telecommunications or Computer equipment or software.

You will not in any way, whether directly or indirectly, expose the Services to any computer virus or other similarly harmful or inappropriate material or device.

Without limiting the generality of the foregoing, your use of the Services is subject to the following restrictions:

1. Except as expressly stated herein, no part of the Services, Luxury Hedge Information and/or Marks contained therein may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, without Luxury Hedge’s prior explicit written consent;
3. You shall not access the Services in order to build a similar or competitive service;
4. You may not use the Services in connection with material which promotes illegal activities, or the violation of any local, state, national, or international law or regulation;
5. The Services may not be used or accessed by any automated machine, bot, spider, or such other automated feature or service;
6. You may not remove, circumvent, disable, damage or otherwise interfere with any features of the Services, or attempt to gain unauthorized access to any portion thereof through any means, or interfere with, corrupt, or disrupt the operation or performance of the Services or the ability of any other person to use them (including, without limitation, by attempting to degrade the performance of the servers in any way);

You agree not to upload, post, reproduce or distribute any information from the Services without first obtaining the permission of the owner of such rights and the prior written consent of Luxury Hedge. Except as set out elsewhere in these Terms and Conditions, none of the intellectual property rights belonging to Luxury Hedge in and relating to the Services may be used, copied, published or distributed by you without our prior written consent.

You are prohibited from, and hereby represent and warrant that you shall not: (i) copy, store, sell, license, distribute, transmit or duplicate to any third party or to any person any Luxury Hedge Information or any part thereof in any form or by any means; (ii) make Luxury Hedge Information available on any website or in an application, or available to the public via the internet or otherwise; (iii) use Luxury Hedge Information for the purpose of creating and/or operating (directly or by any third party) any product, index or service, or in any other manner without Luxury Hedge’s permission; and you hereby acknowledge that Luxury Hedge are the owners of the intellectual property rights in, and relating to, the Luxury Hedge Information and the Services.

Governing Law and Court Jurisdiction

These Terms and Conditions and you access and use of the Services shall be governed by and will be interpreted in accordance with the laws of New South Wales, Australia.

This is the case regardless of whether you reside anywhere else in the world.

You submit to the exclusive jurisdiction of the courts of New South Wales, Australia, in connection with these Terms and Conditions and you access to and use of the Services.

General

If any part of these Terms and Conditions are held unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.

We will not be prevented from taking any further action under the Terms and Conditions, if we fail to enforce the rights granted under these Terms of Conditions. Failure to assert any right at any time shall not constitute concession or waiver.

Membership terms and conditions

You can become a member of Luxury Hedge through a subscription. This will entitle you to access premium content (Premium Content). Subscriptions can be monthly or yearly, and may be non-recurring or recurring. Options will be available on sign up.

If you become a subscriber of a Luxury Hedge membership to access Premium Content then the following terms apply to your membership and/or subscription, in addition to the above general terms and conditions.

If you access Premium Content via applications you may also be subject to third party terms such as the Apple Terms of Service, available at Apple Terms and Conditions. If you purchased your membership / subscription via a third party (e.g. the Apple App Store, Google Play), your subscription may be subject to different terms and conditions as determined by that third party and you will need to raise any issues you may have directly with the third party. We will not have any liability to you to the extent that the terms of those subscriptions conflict with these terms.

Your membership / subscription

We may modify the type, content and availability of the Premium Content at any time, without notice to you. This may include adding new content sections, removing some content sections, or enabling free access to part or all of the Premium Content for any period of time. Your will not be eligible for a full or partial refund of your membership/ subscription if this occurs.

We are not liable to you for any loss or damage that you or any other person may incur in connection with your membership / subscription, whether direct, indirect, consequential or otherwise or which result from our negligence, wilful acts or omissions or material breach of these terms. Our maximum liability to you directly or indirectly is limited to the membership/ subscription fees paid for the period.

Your subscription is for your personal use only. You may not share log-in details or use your subscription for a commercial purpose. You may not copy or publish any information in the Premium Content on a third party publication or site. If we detect or suspect misuse of your access to Premium Content we may contact you and/ or suspend your membership/ subscription. If we cannot resolve the matter we may terminate your subscription without refund. We may otherwise cancel your membership/ subscription for any reason, with a full refund of the prorated payment period remaining.

Pricing and refunds

Membership /subscription fees are not refundable except to the extent required by law.

We charge in the currency as stated at the payment check out.

If you order a recurring membership, you agree to pay the membership price at the payment intervals stated when you order your membership/ subscription.

We can change our pricing and fees at any time. Where you have a recurring membership / subscription we will give you at least 14 days notice for any change. Notice will be given by email to the email address connected to your membership / subscription. Any price change will apply from your next billing date after the notice period. If you would like to cancel your membership / subscription, you can cancel before the end of the billing cycle.

Membership /subscriptions purchased via the website luxuryhedge.com can be cancelled at least three days before the membership /subscription renewal date. Longer cancellation notice requirements may apply for memberships /subscriptions purchased via the App Store or Google Play Store.

You will have access to your membership until the end of your paid period.

Premium Content information

The information contained in the Premium Content, including but not limited to specific product prices, are estimates only, based on worldwide prices, exchange rates and tax refunds. All Premium Content is derived from publicly available information. The accuracy may be affected by any number of things at any one time, including currency fluctuations, pricing fluctuations, tax refund amounts available to you, and website error. We make no guarantees on the accuracy of the Premium Content and you agree to use the website in line with this understanding. Our general Disclaimer also applies.
